Terms of Service

These Terms of Service (the "Terms") form an agreement between you and MyMedia ("MyMedia", "we", "us" or "our"), run by Jessica Gaspar, an independent developer based in Portugal, and govern your use of the website at mymedia.page (the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. How we handle your personal data is described in our Privacy Policy.

1. Your account

  • You must be at least 13 years of age to create an account.
  • Each account may be used by one person only. You are responsible for keeping your password secure and for all activity that takes place under your account.
  • Your username must not impersonate any other person and must not be offensive. You may change your username once every 30 days; when you do so, existing links to your page will stop working.
  • You may delete your account at any time from Settings → Account.

2. Your content

You retain ownership of the reviews, comments, lists, profile information and any other content you add to the Service ("Your Content"). Because MyMedia is a public diary, you grant us a non-exclusive, royalty-free licence to store Your Content and display it publicly on the Service for as long as it remains on your account. This licence ends when you delete the content concerned or your account.

You agree not to post any content that:

  • is unlawful, or infringes the copyright or other rights of any third party;
  • harasses, threatens or targets other people, or is hateful;
  • is sexually explicit, or discloses another person's private information;
  • constitutes spam or advertising, or is misleading.

You also agree not to attempt to disrupt, overload or scrape the Service, to gain unauthorised access to other users' accounts, or to circumvent the Service's limits, including those that apply to Supporter features.

3. Reporting and moderation

Any registered user may report a profile, review, comment or list. Where content breaches these Terms, we may hide it. You may delete any comment left on your own entries and lists, and you may block another account: neither of you can then follow the other, or like or comment on the other's entries and lists. Where an account breaches these Terms repeatedly or seriously, we may ban it, which removes its entire page from public view. If you believe a moderation decision was made in error, you may contact contact@mymedia.page and we will review it.

4. Supporter tier

  • The Service is free to use. The optional Supporter tier is a monthly subscription sold by Polar Software Inc. ("Polar"), which acts as merchant of record and reseller: your purchase is made from Polar, under Polar's Buyer Terms, and Polar processes the payment, taxes, receipts and refunds.
  • The price is shown on the Supporter tier page. VAT or sales tax is added where it applies and shown at checkout. The subscription renews every month until you cancel it.
  • You can cancel at any time in Settings → Supporter (Manage subscription). Your Supporter benefits then stay active until the end of the period you have already paid for, and the subscription does not renew. Payments for past periods are not refunded, except where the law or Polar's Buyer Terms provide otherwise.
  • If you delete your account, your subscription is cancelled immediately, and the rest of the current period is not refunded.
  • When your subscription ends, Supporter benefits cease, but none of the content you have created is lost; for example, a Supporter theme you selected is retained and is restored if you become a Supporter again.
  • Supporter benefits may change over time. We may also grant Supporter access free of charge at our discretion.

5. Third-party media data

Titles, cover images and other media details are provided by third-party databases, listed on the Credits page. We do not own this data and make no guarantee as to its completeness or accuracy, and these services may occasionally be unavailable.

6. Availability of the Service and liability

The Service is operated by a single individual and is provided on an "as is" basis. We take reasonable steps to keep the Service available and your data secure, but we do not guarantee that it will be uninterrupted or error-free. We may add, change or remove features at any time.

To the fullest extent permitted by applicable law, we shall not be liable for any indirect loss arising from your use of the Service. Nothing in these Terms limits any rights you may have as a consumer under Portuguese or European Union law.

7. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate any account that seriously or repeatedly breaches these Terms.

8. Changes to these Terms and governing law

We may amend these Terms from time to time. If we make material changes, we will give notice on the Service before they take effect, and your continued use of the Service after that date constitutes your acceptance of the amended Terms. These Terms are governed by the laws of Portugal.
